The article presents a set of articles on the present and projection of the scholastic tradition. The starting point is the anthropological turn that, within scholasticism and at the beginning of the fourteenth century, privileged the study of ethics, law and politics and, consequently, the forced development of a moral theology concerned with the human coexistence. The second scholasticism, prolonging this tradition throughout the 16th and 17th centuries, could not remain oblivious to the implications of the profound changes that were (...) taking place: the Discovery of America, the Protestant Reformation, the development of a commercial proto-capitalism and the strengthening of the monarchies. As the Reformation was consolidated in a good part of the European territories, intellectual borders were raised between the various confessions. However - and this is the focus of the papers presented - these borders were porous and, despite the climate of confrontation, various indirect communication channels managed to maintain a single intellectual republic. Cualquier estudio focalizado en la ontología propuesta por Leibniz debería prestar atención a conceptos claves, tales como esencias o posibilidades, existencia o actualización, contingencia, necesidad y libertad, entre otros. Al aproximarse a estas nociones, Leibniz reconoció abierta y explícitamente que los temas por los cuales él se interesaba habían sido tratados por Francisco Suárez, René Descartes y Baruch Spinoza. No obstante, se detecta una falta de coincidencia entre las posiciones adoptadas por estos pensadores y las tesis defendidas por (...) Leibniz. Tal diferencia resalta cuando dicho filósofo se propuso explicar, de un modo claro, distinto y conciso, la predisposición de las esencias para existir. Este deseo metafísico trasciende cualquier modalidad de reduccionismo lógico, y si se materializara, el resultado sería una actualización que Leibniz tiene a bien presentar, sin embargo, como contingente y limitada en la mayoría de los casos. El objetivo de este estudio se plantea, en términos de filosofía jurídica, la siguiente cuestión: ¿como debería reaccionar nuestro sistema judicial ante la presencia de otros sistemas regulativos obligatorios para grupos sociales distintos de la mayoria? Previamente el articulo erige un concepto viable de pluralismo cultural evitando los reduccionismos subyacentes: el reduccionismo que identifica pluralismo cultural con el impacto de corrientes migratorias en la unión europea; el reduccionismo que deriva del mantenimiento de la imposibilidad de existencia de derechos de grupo; (...) el reduccionismo que considera patológica la diversidad; el reduccionismo que equipara el pluralismo cultural con el pluralismo de valores; etc. Se llega así a la conclusión de que, en primer lugar, la cultura es conflicto, de juicio, y en segundo lugar, que la búsqueda de "una identidad cultural propia" es un proyecto sin pretensiones. La parte final de este análisis explicita el problema en la unión europea y enfrenta las relaciones entre pluralismo y relativismo desde el punto de vista de la teoría de los derechos humanos. The Coronavirus Disease 2019 pandemic, now a global health crisis, has surprised health authorities around the world. Recent studies suggest that the measures taken to curb the spread of the COVID-19 outbreak have generated issues throughout the population. Thus, it is necessary to establish and identify the possible risk factors related to the psychosocial and psychophysiological strain during the COVID-19 outbreak. The present extensive literature review assesses the social, psychological, and physiological consequences of COVID-19, reviewing the impact of quarantine measures, (...) isolation, vast human loss, social and financial consequences in the family’s economies, and its impact on the psychological health of the population. We also discussed the effect of psychophysiological factors, considering the impact of physical inactivity and modifications in nutritional habits, at psychological and physiological levels. The present review includes an actualized to date bibliography, articles for which were methodologically analyzed to verify they met the standards of quality and scientific accuracy. Authors understand the pandemic as a multifactorial event for which only a profound and extensive analysis would lead to better compression and efficient intervention in the near future. (shrink)

La noción ilustrada de opinión pública apelaba a un circuito de comunicación racional que enlazaba a los actores (de la esfera pública burguesa primero, de la sociedad civil después), con las normas vinculantes emanadas de las instancias formales de creación y aplicación de la ley. Este enlace entra en crisis en el siglo XIX, y parece abandonarse definitivamente con el advenimiento de la sociedad de masas, la expansión de los medios y la autonomización del sistema político. Este trabajo analiza, en primer lugar, la recuperación de la opinión pública como mecanismo articulador entre sociedad civil y sistema político. Luego se expone la caracterización de la opinión pública como filtro y selección de un campo de sentido para la decisión política. La intención es mostrar que, funcionalmente adaptadas a la realidad de las sociedades complejas, ambas caracterizaciones siguen afirmando una relación fuerte entre opinión pública y decisión política legítima. Este trabajo se enmarca dentro de un proyecto de investigación más amplio sobre las difíciles relaciones entre la elaboración de la decisión democrática y el de la conformación de la opinión pública, lo que se debe a que ambos fenómenos, la democracia y la opinión pública, parten de presupuestos filosófico-políticos diferentes. Como primer paso se ofrece una serie de precisiones sobre el concepto de opinión pública, que se articulan desde dos ejes (proceso-producto y holismo-atomismo). El papa Francisco tiene una particular noción de pueblo al cual ha caracterizado, entre otros calificativos, de místico o mítico. En este sentido, recientes trabajos muestran que la noción de pueblo que el Papa maneja y desarrolla en su magisterio tiene su origen en la denominada Teología del Pueblo, doctrina de clara raigambre latinoamericana. Sin embargo, en este trabajo queremos proponer nuevos elementos conceptuales que podrían abonar la hipótesis de que la influencia más remota e indirecta –aunque no de (...) menor peso– del Papa se retrotrae a los desarrollos teóricos de otro Jesuita, Francisco Suárez, quien en el marco de su filosofía política se refirió al pueblo como cuerpo místico. Las democracias distan mucho de ser perfectas, como lo demuestra el hecho de que una parte de la población se encuentra en situación de exclusión y vulnerabilidad. Condición que, cuando menos, les impide participar de la vida pública y, por tanto, de contribuir a formar las políticas públicas que, en materia de derechos económicos, sociales y culturales, habrían de darse para paliar esos déficits en la protección de los derechos, que son también déficits de la propia democracia. Este contexto, obliga (...) a adoptar un enfoque basado en derechos humanos para realizar un diagnóstico de los principales problemas a los que se enfrentan las democracias en la actualidad y hacia el futuro. Razón por la cual ha de atenderse al tipo de ciudadanía que genere las menores dificultades para acceder a dichos derechos, y, en consecuencia, permita construir una estructura democrática y social evitando las causas de dominación. No bastaría esta reflexión si no se propusiesen cauces y campos de participación, en procesos, como los presupuestarios, ya que afectan e impactan en la protección y garantía de los derechos económicos, sociales y culturales, fundamento del disfrute de los demás derechos. Diferenciamos en este articulo entre problemas externos y problemas internos de la democracia. Los primeros los ejemplificamos en el teorema de Arrow, en el conflicto entre derechos fundamentales y principio de elección y en la paradoja de la derogación. Los problemas externos, en cuanto insolubles, no son responsabilidad nuestra. Los segundos sí lo son. De ahí que es un deber moral ensanchar al máximo la democracia. Lo contrario seria reducirla a su simple y avalorativa utilidad, quedarse en un academicismo que,escolásticamente, (...) se limita a pequeñas distinciones y confundir, además, ciencia política con filosofía política. En el presente artículo se analizará, en primer lugar, la importancia de incorporar la dimensión social al análisis jurídico a partir de un enfoque interdisciplinario riguroso que permite articular las exigencias metodológicas de cada ciencia y así evitar el sincretismo (I). Luego, se desarrollará cómo la sociología de los valores de Nathalie Heinich puede resultar un marco teórico-conceptual relevante para dotar de racionalidad al discurso jurídico cuando se incorporan argumentos de naturaleza social (II). Finalmente, se planteará que lo expuesto en (...) el punto anterior permite incorporar una herramienta relevante al momento de argumentar y de justificar la decisión de casos difíciles, dificilísimos y estructurales en los cuales, entre otros aspectos, deben emplearse principios jurídicos (III). Las posibilidades que ofrece el desarrollo de la inteligencia artificial y el manejo de macro datos son ingentes. Sus aplicaciones se extienden también al ámbito sanitario en el que resulta difícil separar la práctica médica y el proceso creciente de digitalización. Sin embargo, no todo es luz en este nuevo universo algorítmico. Existe también otro lado apenas perceptible, más opaco, pero impregnado de brumas provenientes de los intereses y expectativas económicos de las grandes empresas multinacionales. De ahí la necesidad de (...) incidir en la protección de los datos personales sanitarios, así como en la salvaguarda de la privacidad del paciente; teniendo presente que la defensa de los derechos fundamentales constituye un instrumento inequívoco de limitación del poder, en este caso, tecnocientífico. Este trabajo aborda el fenómeno de involución que se ha producido en los últimos años en el entendimiento de las relaciones entre libertad y seguridad en la tradición democrática. Tras el 11 de septiembre de 2001, la estrategia de guerra contra el terrorismo sustituye la lógica del Estado de Derecho por la del Estado de sitio y difunde el viejo recurso del miedo al otro y el paradójico repliegue en un nosotros cada vez más reducido, incluso en sociedades que hacen (...) bandera del universalismo. Entre el miedo a la amenaza exterior y el miedo al enemigo interno, se acrecienta el rechazo a la inmigración, construida de nuevo como un problema-obstáculo. El autor muestra, además, como la actual crisis económica se ha convertido en un factor añadido que ha multiplicado los discursos acerca de la urgencia de ofrecer respuestas adecuadas frente a la inmigración en las que se opta por una lógica jurídica de la excepcionalidad, de derogación o al menos suspensión de alguno de los principios y reglas del Estado de Derecho cuando se trata de regular el status jurídico de quienes son identificados como amenaza. In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. This special issue examines critical ethical, legal, and policy debates surrounding brain trauma in sport, focusing on challenges in concussion management practices and protocols. Brain injury concerns extend beyond traditional contact sports like boxing, encompassing sporting activities involving rapid acceleration, deceleration, and surface impacts, such as cycling and equestrian sports. Among such problems are the identification and management of brain injuries, the roles of officials and healthcare professionals, and the broader implications for sport integrity and athlete careers. The special issue (...) is organized into four sections: ethics of concussion medicine, socio-legal aspects, sport ethical dimensions, and public health policies. Contributions discuss concussion management in youth sport, sport federations’ and athletes’ duties involvement in concussion-related research, strategies to support and enhance athlete autonomy, public health-informed brain injury frameworks, conflict of interest in concussion management protocols, litigation and liability in concussion research and collaboration, race and genomics in brain-injury scientific discourses, rule changes in sport to reduce head impact, the contextual nature of brain injury and athlete decision-making, the ethical use of genetic testing in brain-injury related research, marketing strategies to advertise tackle football to children and adolescents, and policy purposes and evidence underpinning concussion management practices. This comprehensive exploration offers diverse disciplinary insights, making it a crucial resource for sport humanities scholars, policymakers, and medical professionals. In this paper, we explore the issue of the elimination of sports, or elements of sports, that present a high risk of brain injury. In particular, we critically examine two elements of Angelo Corlett’s and Pam Sailors’ arguments for the prohibition of football and Nicholas Dixon’s claim for the reformation of boxing to eliminate blows to the head based on the empirical assumption of an essential or causal connection between brain injuries incurred in football and the development of a degenerative (...) brain disease known as chronic traumatic encephalopathy ; and John Stuart Mill’s rejection of consensual domination. We present four arguments to contest the validity of Corlett, Dixon’s and Sailor’s positions. Specifically, we argue that certain autonomy-based arguments undermine paternalist arguments for reform; the nature of the goods people pursue in their lives might justify their foregoing future autonomy; Mill’s argument against consensual domination draws on ambiguous and arbitrary distinctions; the lack of consensus and empirical evidence regarding CTE arising from brain injuries in sport underdetermines calls for reform. We conclude that these proposals for reforming or eliminating sports with high risks of brain injuries are not well founded. (shrink)

In a previous paper entitled ‘Beyond Physiology: Embodied Experience, Embodied Advantage, and the Inclusion of Transgender Athletes in Competitive Sport,’ we claim that analyses of the inclusion or exclusion of transgender athletes in competitive sport must go beyond physiological criteria and incorporate the notions of embodied experience and embodied advantage. Our stance has recently been challenged as impractical and excessively exclusionary. In this paper, we address these challenges and build upon them to expand on the policy implications of our original (...) framework, highlighting that embodied experience and embodied advantage heavily influence athletic performance. We differentiate competitive fairness from justice to, with an emphasis on the inclusion of transgender women in competitive sport, formulate a justice-based argument for maximizing inclusion. Afterward, we identify ideal and nonideal policy recommendations connected to our analysis of embodied experience and embodied advantage. We ultimately advocate for a qualified inclusion that assesses potential residual (physiological and embodied) advantages while striving for justice and competitive fairness. (shrink)

This article critically examines the development and consensus outputs of the Concussion in Sport Group. We examine the six Consensus Statements between 2001 and 2023 to explore the challenges that the presence of contextual forces pose to the development of effective and ethically justifiable medical guidelines to manage situations involving brain-injured athletes. First, we discuss the implicit and explicit ethical framework and goals underlining the statements. Secondly, drawing on a relational account of athlete choice, we expound on the limitations of (...) the framework, concentrating on those resulting from a simplified understanding of athlete autonomy. Thirdly, we conclude by proposing a series of recommendations to improve concussion management protocols: (1) adopting a broader understanding of autonomy built upon relational accounts, beyond just the healthcare professional-athlete relationship; (2) further minimizing conflicts of interest that increase athletes’ vulnerability and hinder decision-making ability; (3) enhancing healthcare professional training to allow better adjustment of treatment plans to athletes’ contexts; and (4) promoting research on sociocultural elements affecting athletes’ vulnerability and autonomy. Since Sigmund Freud developed and popularized psychoanalysis, this psychological theory has significantly influenced contemporary thinking, particularly in philosophical disciplines focused on understanding human behavior and addressing social problems. Take the examples of political philosophy, race theory, and feminist thought, among many others. However, although sport philosophy qualifies as one such discipline, scholars in this field have given little to no attention to psychoanalysis and psychoanalytical theorists. Remarkably, psychoanalytical notions, especially those of Eric Berne and Norman O. Brown, significantly shaped Bernard (...) Suits’ pioneering thoughts on games. Nevertheless, sport philosophers have largely overlooked the importance of psychoanalysis in Suits’ examinations of games and, more broadly speaking, rarely attempted to apply psychoanalytical concepts to their analyses of sport. In this paper, I explain the psychoanalytical roots of Suits’ theory of games and explore how much of his theory of games is indebted to psychoanalysis. Specifically, I first compare Suits’ analysis of unconscious gameplay to psychoanalytic concepts of repression and neurosis. Subsequently, I explore the alignment between Suits’ views on gameplay and psychoanalytic accounts of play and pleasure. To conclude, I examine the therapeutic and emancipatory character of Suits’ proposal, drawing parallels between his philosophical corpus and critical theorists whose critical analyses of modern society are heavily indebted to Freud. This paper addresses the possibility of robots engaging in sports. Recently, several movies like Ex-Machina, Chappi, and Transcendence challenge the spectator to think of the consequences of creating artificial intelligences. Although we refer to athletes who have outstanding sporting performances as machines, for example, in cycling people say ‘the cyclist looked like a machine with wheels,’ the potential participation of such AI in sport has not been addressed. For our argument’s sake, we will assume that the creation of human-like robots (...) who will mirror human athletes’ behavior in the playing field will be possible. Recent advances in cybernetics and robotics point in this way. As argued in the literature on philosophy of mind, the fact that intelligent robots seem to be doing something does not imply they are actually doing it. Understood in this way, sport can be conceived as a particular ‘imitation game’ or Turing test, which permits us to distinguish between an artificial intelligence... (shrink)

In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

Utopia outlined in the sequel, covering a wide range of topics. Filip Kobiela explores counterfactual situations in Suits’ oeuvre. Christopher Bartel and Gwen Bradford scrutinize the ethical nature and ramifications of Suits’ claim that life is an unconscious game. R. Scott Kretchmar and John S. This article examines multinational banks’ approaches to corporate social responsibility in developing countries’ subsidiaries, particularly in Latin America. Building on in-depth case studies of two MNBs that are based in Europe and market leaders in Latin America, we analyze their CSR motivations and outcomes in host countries. We examine institutional environments by applying the national business system framework, and we suggest missing categories in its financial and educational dimensions. We theorize how institutional necessity determines MNBs' CSR in developing countries. Finally, (...) we examine the CSR outcomes in Latin America, where banks’ responsible conduct has led to major improvements in educational levels and financial inclusion. In this book symposium, world-leading Suits scholars analyze the Suitsian conception of gameplay and its relevance to his views on (...) Utopia outlined in the sequel, covering a wide range of topics. Filip Kobiela explores counterfactual situations in Suits’ oeuvre. Christopher Bartel and Gwen Bradford scrutinize the ethical nature and ramifications of Suits’ claim that life is an unconscious game. R. Scott Kretchmar and John S. Russell present thoughtful critiques of Suits’ musings on Utopia. William J. Morgan’s contribution integrates contemporary work studies to illuminate Suits’ utopia. Several authors, such as William J. Morgan, John S. Russell and R. Scott Kretchmar, have claimed that the limits between the diverse normative theories of sport need to be revisited. Most of these works are philosophically grounded in Anglo-American philosophical approaches. For instance, William J. Morgan’s proposal is mainly based on Richard Rorty’s philosophy. But he also discusses with some European philosophers like Jürgen Habermas. However, Habermas’ central ideas are rejected by Morgan. The purpose of this paper is to analyse (...) Morgan’s rejection of Habermas’ thought and show that a more appropriate normative of sport that explains better our current sporting world can be achieved by drawing on the German philosopher’s ideas. In this paper, we argue that the fact that there were prominent citizens of different Greek cities who adhered to Epicureanism, felt themselves Epicurean, and were recognized as such, shows that slogans such as “live unnoticed” and “do not participate in politics” (which suggest a complete apoliticism on Epicurus’ and the Epicureans’ part) misrepresent the true meaning of the Epicurean staying away from contingent politics. Our article shows the interaction between Epicurus and the Epicureans and the Greek cities through the (...) analysis of documents (some of them, well known -such as Epicurus’ Testament, which shows the connections of the philosopher with the political life of the city-, others less known of epigraphic character) related to different ancient cities. In this paper, linguistic-analytic philosophy has been identified as the dominant methodology in the philosophy of sport. The hermeneutics of sport is contrasted with linguistic-analytic philosophy by analyzing Heidegger’s view of Truth. In doing so, two views of philosophy are compared: ontology or description. Sport hermeneutics’ task has to do with description. Hermeneutical explanations of sport attempt to describe the facticity of sport. Such a facticity is formed by three moments: embodiment, capabilities, and tradition. They are not components of sport (...) that can be identified as essential components but rather, they are identifiable only for analytic purposes. These three above-mentioned elements cannot be identified as elements, because they are intrinsically intertwined forming a unitary network of meaning. The task of sport hermeneutics is to describe the different relationships that compose such a network of meaning. In doing so, sport is a humane activity linked to the constitutive human task of making sense of reality by projecting meaning into it. (shrink)

This study attempts to analyse the relationship between two key psychological variables associated with performance in sports - Self-Determined Motivation and Competitive Anxiety - through Bayesian Networks analysis. We analysed 674 university students/athletes from 44 universities that competed at the University Games in México, with an average age of 21 years (SD = 2.07) and with a mean of 8.61 years’ (SD = 5.15) experience in sports. Methods: Regarding the data analysis, first a CHAID algorithm was carried out to determine (...) the dependence links between variables, and then a Bayesian networks was developed. The validation of the BN revealed AUC values ranging from 0.5 to 0.92. Subsequently, various instantiations were performed with hypothetical values applied to the “bottom” variables. Results showed two probability trees that have extrinsic motivation and amotivation at the top, while the anxiety/activation due to worries about performance was at the bottom of the probabilities. The instantiations carried out support the existence of these probabilistic relationships, demonstrating their scarce influence on anxiety about competition generated by the intrinsic motivation, and the complex probabilistic effect of introjected and identified regulation regarding the appearance of anxiety due to worry about performance.
